CALLER: Oh. Do you know of anybody that does?

CLINIC: Indianapolis has a clinic that does them. I can give you their phone number.

CALLER: Okay.

CLINIC: It’s 1-800-352-1901.

CALLER: Do you know if you have to be a specific age for that? I’ll be 14 in March.

CLINIC: You’ll probably need a parental consent.

CALLER: But my boyfriend’s 22. Could he just sign whatever they need to sign? Is he old enough?

CLINIC: No. You need a parental consent. It’s the law in Indiana.

CALLER: Is there any way not to tell my parents? It’s just they hate him. They can’t find out at all.

CLINIC: You can try calling that clinic and see if there are other states that may not require parental consent.

CALLER: Okay.

CLINIC: Okay?

CALLER: Well, could I come in there and get a pregnancy test?

CLINIC: Yeah, you can.

CALLER: Would you guys have to tell anybody that I was there?

CLINIC: Well, we’d have to report it to CFS.

CALLER: Why?

CLINIC: Because of your age.

CALLER: But I don’t understand.

CLINIC: We just have to. It’s just a state law that we have to report —

CALLER: Would I get in trouble?

CLINIC: They would just notify your parents.

CALLER: But they can’t tell my parents.

CLINIC: That’s what I mean. Just contact the clinic number that I gave you.

CALLER: But if I was getting a pregnancy test, they would have to tell my parents?

CLINIC: Just contact them, because if it’s abortion related, then it’s all kept confidential.

CALLER: Oh.

CLINIC: That’s what I’m trying to tell you.

CALLER: Well, I was just told to come to where you’re at. So that’s why —

CLINIC: Did you contact the Women’s Clinic already?

CALLER: No. Like my friend told me that I should go to you.

CLINIC: Just contact the Planned Parenthood Indianapolis because they’re better equipped with all that information, the legalities behind everything.

CALLER: Okay.

CLINIC: Because we’re limited in what we can do at this clinic. We don’t do the same services at each clinic.

CALLER: Okay. But if I’m not pregnant, could I get birth control there where you’re at?

CLINIC: Yeah.

CALLER: And you wouldn’t have to tell anybody that I was on birth control?

CLINIC: Hold on a second. I’ll just make sure because of the age thing. And how old is your boyfriend?

CALLER: He’s 22.

CLINIC: Okay. We would definitely have to report that then, because of his age.

CALLER: Why?

CLINIC: Because it’s considered rape.

CALLER: What? I don’t understand. We’re in love. We’re going to get married.

CLINIC: I know. But in the legal proceedings and everything else — in the law — it’s considered statutory rape.

CALLER: But he’s not raping me. We’re in love. I don’t understand.

CLINIC: I know that, hon. But you have to understand that in Indiana anything under — if you’re having sex with somebody who is an adult, it’s considered state statutory rape.

CALLER: Well, what can I do? Where can I go?

CLINIC: I would try contacting the Women’s Choice — have you taken an over-the-counter pregnancy test or anything?

CALLER: No.

CLINIC: Try that first just to make sure if you are pregnant or not. And then after that, you can give us a call. You can ask for Angie. She’s our manager here.

CALLER: Okay. Well, do you know like — my friend said that my parents have to sign some stuff. Is it all right if my boyfriend does it because he’s 22?

CLINIC: That I’m not sure. That I can’t answer you. You’d have to ask them.

CALLER: Is there like — well do you know if there’s like an age limit or anything to have an abortion? Like I’ll be 14 in March.

CLINIC: No, not that I know of.

CALLER: Okay.

CLINIC: Okay? You’ll just have to call and ask, talk to them about it.

CALLER: Okay. Do you know like — do you know if my parents have to know or anything?

CLINIC: That I’m not sure of either.

CALLER: Well, could I come into there and get a pregnancy test?

CLINIC: To make sure that you are?

CALLER: Would you guys have to tell my parents?

CALLER: They just can’t find out at all.

CLINIC: No. We don’t — that’s confidentiality.

CLINIC: And it’s $5.00 for the pregnancy test.

CALLER: Okay. Is it all right if my boyfriend brings me?

CLINIC: Um-hum.

CALLER: It is?

CLINIC: Um-hum.

CALLER: Okay. Do you guys have to know anything about him at all?

CLINIC: No.

CALLER: All right. So like you wouldn’t be asking like a whole bunch of questions or anything?

CLINIC: No. We just do the pregnancy test on you and talk to you about it, and give you whatever information you’d like to have.

CALLER: So if it ended up that I wasn’t pregnant, do you guys do birth control there?

CLINIC: Yes, we do.

CALLER: And you wouldn’t have to tell anybody that I was on birth control?

CLINIC: No. That would be your choice.

CALLER: All right.

CLINIC: Okay? And to that, it’s $27 to do HOPE which is called the (unclear) exam, and then your pills are $11 per pack.

CALLER: All right. Well, is it okay if like I call you back to get an appointment?

CLINIC: You don’t need an appointment to do neither one of those.

CALLER: Yeah. I was wondering if you guys do abortions there.

CLINIC: No, we don’t.

CALLER: Okay. Do you know of anybody that might?

CLINIC: There’s a clinic in South Bend and there’s a clinic in Niles. Those are the only two in the are. You want those numbers?

CALLER: Yes, please.

CLINIC: The clinic in Niles is 616-683-6100. And the clinic in South Bend is 219-272-1010.

CALLER: My friend told me that since I’ll be 14 in March that my parents have to sign some stuff —

CLINIC: Yes.

CALLER: — but my boyfriend’s 22. Could he do that?

CLINIC: No, uh-uh. You have to have parental consent. And no one else, unless they’re a legal guardian, can do that.

CALLER: Is there any way not to tell them at all? Because they can’t find out. I don’t know what would happen.

CLINIC: The only other way in either Michigan or Indiana is to be declared — I can’t think of the world. You have to be emancipated.

CALLER: What does that involve?

CLINIC: Well, that involves going to court and have a judge declare that you are taking care of yourself and that your parents are not legally bound to take care of you.

CALLER: Oh. Well, do I need a lawyer for that?

CLINIC: Well, there’s a lot of paperwork to fill out, and you have to make a certain amount of income.

CALLER: But I’ll be 14 in March. I don’t have a job.

CLINIC: My only concern with this whole conversation is that if you’re 14 and your boyfriend’s 22, there’s enough of an age there that that’s a problem.

CALLER: What kind of problem? What do you mean?

CLINIC: Well, legally that’s against the law. That’s called statutory rape.

CALLER: What? What do you mean?

CLINIC: At 14 you’re not old enough to consent to have sex with a 22-year-old.

CALLER: But we’re in love. We’re going to get married.

CLINIC: Okay. That’s besides the point. I’m just mentioning that to you. You may have problems becoming emancipated. I don’t think a lawyer under those circumstances or a judge under those circumstances is going to do that. I would talk to those other two clinics.

CALLER: What could I do then?

CLINIC: Well, you may need to talk to your parents.

CALLER: But I can’t tell my parents.

CLINIC: And why is that?

CALLER: If they found out, they’d be furious. I don’t know what would happen.

CLINIC: At some point there’s no way around that. I mean unfortunately — in either of these states they can’t do anything about it. You have to have a parental consent, and they have to prove that. They have to have picture i.d.s and they have to have birth — it’s not anything that you can work around.

CALLER: Well, could I come in there to get a pregnancy test? I’m just scared because I missed a period, so I don’t know really. But could I come in there and see?

CLINIC: You could set up an appointment. When was your last period?

CALLER: It was like the second week in December.

CLINIC: Okay, hold on.

CLINIC: We have an opening tomorrow at 9:30 or tomorrow afternoon at 2:15.

CALLER: Well, I would have to call my boyfriend to see when he could get off work, but okay.

CLINIC: You’d have to let us know.

CALLER: Well, do you guys have to tell anybody if I’m getting a pregnancy test?

CLINIC: No. We don’t. We don’t need parental consent here. That’s a different ball game.

CALLER: And you wouldn’t have to tell anybody about my boyfriend?

CLINIC: No. If you — if you’re not pregnant — there’s always a chance that you’re not pregnant — then the smart thing would be to get on a method of birth control if you’re going to be sexually active.

CALLER: You guys wouldn’t have to tell anybody about that?

CLINIC: Not at 14, no.

CALLER: But you wouldn’t tell anybody about my boyfriend?

CLINIC: Not if you’re coming in for a pregnancy test. I’m not going to tell anything about it. We’re not going to give any information to anybody.

CALLER: Okay. Well, could I call you back?

CLINIC: Sure. Let me know.

CALLER: What was your name?

CLINIC: Well, anybody here can schedule your appointment. Just tell them you need to set up an appointment for a pregnancy test. You’d like to come in tomorrow. And it’s a real small clinic, so we’ll get you in, okay?

CALLER: Well, could I come to you? I mean, you’re just nice.

CLINIC: My name is Kim if I’m here.

CLINIC: No, sweetheart. We don’t do them here in this office. Planned Parenthood provides that as a service in our Indianapolis or our Bloomington office. I can give you either one of those numbers.

CALLER: Okay.

CLINIC: Which one would you prefer, Bloom or Indie? They’re both about the same distance from here.

CALLER: I guess I want Indianapolis.

CLINIC: All righty. And that’s called the Women’s Choice. It’s 1-800-352-1901.

CALLER: Okay. I’ll be 14 in March. Is that okay? My friend told me that my parents have to sign some stuff. But my —

CLINIC: They do, sweetie. Under 18 you cannot have that done as a service. In Indiana it’s a state law without parental consent.

CALLER: Oh, well. My boyfriend’s 22. Could he sign it or anything?

CLINIC: No. Your boyfriend has nothing to do with you legally.

CALLER: Oh. Is there any way not to tell my parents?

CLINIC: I don’t think so, sweetheart. You can call and talk to the, but no, I don’t believe so. In the state of Indiana it’s a state law anybody under 18 has to have parental or a legal guardian consent.

CALLER: If I wasn’t pregnant, could I get birth control from you guys?

CLINIC: If you aren’t pregnant, we can provide it as a service, yes.

CALLER: Okay.

CLINIC: But state law will not allow a minor under the age of 18 to have a termination without parental consent.

CALLER: Oh, okay. But if I was on birth control — I’m not real sure if I’m pregnant. But if I wasn’t and I was getting birth control from you guys, do you have to tell anybody anything?

CLINIC: No, we do not because we are protected by the state law because we provide sexually transmitted infection testing and treatment.

CALLER: Oh, okay.

CLINIC: Okay?

CALLER: All right.

CLINIC: We will tell you that — we encourage everybody under 18 — it’s part of our guidelines. We tell encourage you to involve your parents. We’re not here trying to be sneaky. We encourage parental involvement. We tell everybody that we want them to talk to their parents. But I will tell you that we can provide you a service. But if you are 14 or under 14 and sexually active, we have to also give that information to the Child Protective Services. That’s also a state law.

CALLER: So you’d have to tell on me if I was on birth control?

CLINIC: Yes, ma’am. We would have to. If you’re sexually active, and if we have that information, we would have to let Child Protective Services know, yes.

CALLER: Well, what can I do then?

CLINIC: Sweetheart, there’s probably nothing you can do. Talk to an adult. Talk to a parent. If you’re 14 and having sex with somebody — and I wish you hadn’t even told me. He could be arrested for —

CALLER: Arrested?

CLINIC: Absolutely.

CALLER: I don’t — but —

CLINIC: Listen to me. Because the law says, if he is having sex with a minor, and you’re 14 and he’s 22 years old, there’s something not quite right there. I don’t care how old you are, you’re young. You’re considered in the eyes of the law a minor.

CALLER: But we’re in love. We’re going to get married.

CLINIC: Well, sweetheart, if you were married, that’s a different story. But you can’t even get married without the consent or the signature of an adult. So you are not considered able to do those things. Okay?

CALLER: Well, what should I do.

CLINIC: I’m going to encourage you to quit having sex with him first of all until you can get this all lined out. Talk to an adult. If you don’t trust talking to your parents, talk to a school counselor. Talk to a minister. Talk to somebody that you’re comfortable with. You need to find out whether or not you’re pregnant, okay? That’s the first thing you need to do, find out whether or not you’re pregnant. If you’re not, then you need to consider a type of birth control if you’re going to be sexually active.

But I’m going to strongly encourage you to not be involved with this person until you get things all lined out legally, because there’s just a lot of ramification. If you continue to have sex with this person, if your parents wanted to, they could press charges. And yes, he could be arrested for statutory rape. And he should know that himself.

CALLER: Okay. But you’re not going to tell on me?

CLINIC: Do what?

CALLER: You’re not going to tell on me?

CLINIC: We don’t even have your name, okay?

CALLER: Okay.

CLINIC: So no. I’m giving you good, straight-forward advice. Please protect yourself. Please stop having sex with him until you can get things evaluated, okay?

CALLER: Okay.

CLINIC: I don’t have your name, so I’m not going to tell anybody. But what I’m telling you, if you come here and you want a service from us, we want to help you, and we will do what we can. But I’m going to be up front with you and tell you, at 14 and under if you are sexually active, we have to by law report that to Child Protective Services.

CALLER: So I can’t get birth control from you guys?

CLINIC: I did not say that. I told you that if you came here and you’re sexually active, we have to report it. That’s all I’m telling you. We can provide you —

CALLER: But could I get birth control?

CLINIC: Yes, but you’re going to have to have it reported that you were sexually active. And I can’t tell you what happens then. But yes, you can get birth control through us. Okay?

CALLER: Well, I’ll be 14 in March.

CLINIC: Well, sweetheart, if you’re only 13 now, we have to report all this, absolutely, yes.

CALLER: But when I turn 14, could I come in?

CLINIC: You can come in anytime you want, but we’re still going to have to report it at 14 and under. I’m just telling you the facts. Okay?

CLINIC: I’m not trying to keep you from coming in. I’m being right up front with you and very honest.

CALLER: But I don’t understand. We’re in love. We’re going to get married. He’s not abusing me.

CLINIC: Well, the minds of, the eyes in the court it’s considered child abuse.

CALLER: Well, what could happen?

CLINIC: He could go to jail.

CALLER: He could go to jail?

CLINIC: Um-hum.

CALLER: Well –

CLINIC: For rape.

CALLER: What — but he’s not raping me. We’re in love. We’re going to get married.

CLINIC: That’s fine, but in the eyes of the law it is considered rape.

CALLER: Well, is there anything I can do? What can I do?

CLINIC: You can call the abortion clinic. They might be able to give you some ideas.

CALLER: Well, would they have to tell my parents, and arrest my boyfriend?

CLINIC: No. They just won’t be able to see you there without your parental consent, so –

CALLER: But they can’t find out at all.

CLINIC: Then you’re going to have to call the abortion clinic and maybe they can give you some referrals to out-of-state clinics.

CALLER: Oh, okay.

CLINIC: Okay?

CALLER: Would they have to say anything about anything?

CLINIC: You’d have to call the number that I gave you and they can go over that information with you.

CALLER: Well, my friend just told me to go to you guys. Could I get a pregnancy test there?

CLINIC: Yes. It’s $5.00.

CALLER: Okay. Well, do you have to tell anybody that I’m getting a pregnancy test?

CALLER: Okay. Is it — well, my boyfriend has to bring me. Do you have to tell them about him or tell anybody about him?

CLINIC: We don’t care how old you are to get a pregnancy test, or how old the person is that you’re sleeping with.

CALLER: Okay.

CLINIC: The state of Indiana if you want an abortion, okay, you need mom and dad’s consent.

CALLER: Okay.

CLINIC: I’m just letting you know that with his age and your age it’s considered rape. He’s in the wrong. He should not — I mean, legally through the eyes of the law he should not even be touching you. It doesn’t matter if you’re in love or not. It’s still not right. That’s what the law thinks.

CALLER: But are you going to report him if I go in there?

CLINIC: If you have an exam with us or anything like that, yes we would have to report you, but a pregnancy test, no. But I would suggest is that since he’s 21 years of age — does he have his own place?

CALLER: Well, yeah.

CLINIC: Okay. I’d have him buy you a pregnancy test and take it there.

CALLER: Okay.

CLINIC: And then you’re going to have to go — if you don’t want mom and dad involved you will have to go out of state.

CALLER: Oh. Well, if I wasn’t pregnant, do you guys do birth control there?

CLINIC: We do, but with your age we would have to report you.

CALLER: Oh.

CLINIC: Okay? So your option at this point until you turn 15 would be to use condoms.

CALLER: Okay.

CLINIC: Condoms, foam, something like that.

CALLER: Well, you were saying I could go out of state. Which state would I –

CLINIC: You could go out of state to have an abortion.

CALLER: Which state?

CLINIC: The numbers I gave you?

CALLER: Uh-huh.

CLINIC: That’s the number you need to call. They can answer all your questions.

CLINIC: Okay?

CALLER: Well, so if I wanted to come in for a pregnancy test could I – like if I had other questions –

CLINIC: If you have $5, we’ll do a pregnancy test on anybody.

CALLER: Well, if I had any other questions could I call and talk to you?

CLINIC: We would prefer that you call the abortion clinic.

CALLER: Oh.

CLINIC: I tell you what, I’m going to save you some money here. Our pregnancy tests are $25. The WIC office is in the same building we’re in. They get a grant from the state, they do the same test we do, and they’re free. So let me give you their phone number.

CALLER: Do you know if it was negative if I could get birth control there?

CLINIC: You then need to come to us and make an appointment.

CALLER: But would you guys have to tell anybody if I was on birth control?

CLINIC: Well, you don’t have to parents’ permission just to have the pregnancy test. But in the state of Indiana you would have to have a parent’s permission to obtain an abortion.

CALLER: I’ll be 14 in March. Do they still need to know?

CLINIC: So you’re not 14 yet?

CALLER: I’ll be 14 in March.

CLINIC: You’re only 13?

CALLER: Yeah.

CLINIC: Up until 18, you have to have parents’ permission for abortion in Indiana.

CALLER: But I could come in there for a pregnancy test and they wouldn’t have to know?

CLINIC: A pregnancy test, yeah. And it is illegal for your boyfriend to be having sex with you at your age.

CALLER: What do you mean? I don’t understand. How is that illegal? We’re in love.

CLINIC: There’s a law against a man of 21 having sex with a young girl of 13.

CALLER: But we’re going to get married. What could happen to him?

CLINIC: Well, it would depend on whether your family wanted to press charges. But you guys just need to be aware of that; that that is unlawful for him to have sex with you.

CALLER: But we’re in love. We’re going to get married.

CLINIC: Uh-huh. Whatever your feelings may be, that’s just the law, and it’s very black and white.

CALLER: Well, could I still get a pregnancy test?

CLINIC: Sure. You can get a pregnancy test. If you think you’re pregnant, you can have a pregnancy test.

CALLER: You guys wouldn’t have to tell anybody about him?

CLINIC: No. Pregnancy tests you can come and get just on your own.

CALLER: Well, he’d have to drive me. I don’t know how else I would get there.

CLINIC: That’d be okay.

CALLER: Would it be all right if he came in though?

CLINIC: Um-hmm. He can come in. But the nurse would probably want to talk with him some about the situation.

CALLER: Well, would he get in trouble or anything?

CLINIC: She would need to talk to the Welfare Department about it. They would take it from there.

CALLER: They can’t find out. What would happen if they find out?

CLINIC: Well, I’m not sure exactly how they would follow up on that. Would you like to talk to our nurse? Because I know she’s more involved with that than I am.

CALLER: Well, what was your name?

CLINIC: My name’s Ellen.

CALLER: Okay. Well, I guess.

CLINIC: Hang on just a second.

CALLER: Okay.

CLINIC: (Talking to someone else) Karen? You got just a sec?

Is it okay with you if I tell her what your situation is so she can come talk to you and let you know what to expect?

CALLER: Yeah.

CALLER: Hi.

CLINIC: You are 13?

CALLER: Yeah. Well, I’ll be 14 in March.

CLINIC: Okay. It doesn’t matter. If your boyfriend’s that old, then it has to be reported to Child Protective Services.

CALLER: So I couldn’t come in for a pregnancy test or anything?

CLINIC: Yes. If you’re sexually active, and you come in here and tell me you’re sexually active, then I have to report it to the Welfare Department.

CALLER: What if I didn’t tell you?

CLINIC: Then why would you want a pregnancy test?

CALLER: Well, I guess you’re right.

CLINIC: I’d be glad to do it, sweetheart. I’ll be glad to see you, and I’ll be glad to talk to you and whoever. But I just want you to know up front that anybody who is — it’s even against the law for a 17-year-old girl to have sex with an 18-year-old boy. So when that happens, I have to call the Welfare Department. They in turn have to report it to the county prosecutor. But if you are pregnant, then that’s going to be a non-fact because you’re going to be delivering (unclear). And if your boyfriend is 18 or over, I can’t guarantee you that the county prosecutor would not prosecute him because he has in the past.

CALLER: All right.

CLINIC: Okay.

CALLER: Well, is there anything I could do at all?

CLINIC: About what?

CALLER: To not get in trouble.

CLINIC: Not have sex. That’s the only thing you can do. Because if you get pregnant at your age, then you’re going to know that you’re pregnant. That’s something you’re not going to be able to hide.

CALLER: Well, is there someplace I could go at all?

CLINIC: For what, sweetie?

CALLER: To get an abortion?

CLINIC: Not without your parents’ permission.

CALLER: Okay.

CLINIC: Uh-uh, no. I can’t think of any state that would terminate you at your age without parental consent. There may be some, but I’m not familiar with all the laws in Wyoming or Utah or those kind of places.

CALLER: Okay.

CLINIC: If he took you across state lines, then that’s kidnapping. Then he’s in more trouble than ever —

CALLER: Oh, okay.

CLINIC: — at your age.

CALLER: Well, what should I do?

CLINIC: Do you think you’re pregnant?

CLINIC: If you come in here, I have to report it to Child Protective Services that you are sexually active.

CALLER: Do they ever not pursue it?

CLINIC: I’m not aware of a time. The only thing that you can do to absolutely not get in trouble or to not get your boyfriend in trouble is to not have sex.
